General Terms and Conditions

1. Scope
These general terms and conditions apply to all transactions carried out on the website: https://www.artsowell.com administered by Laura Ferrari. Artsowell is a space mainly offering events combining art, sound and well-being. Products and works of art related to this universe may also be offered for sale via this platform. Laura Ferrari reserves the right to amend the general terms and conditions at any time. In all cases, the applicable conditions shall be those in force on the date of the order.
2. Acceptance of the General Terms and Conditions
By confirming your order, you acknowledge that you have read these general terms and conditions and accept them in their entirety.
3. CONDITIONS SPECIFICALLY APPLICABLE TO WORKSHOPS AND EVENTS
3.1. Participation in Events
By participating in a workshop, you agree to behave respectfully towards the other participants and the venue. You are asked to arrive on time so as not to disrupt the smooth running of the workshop.
All materials necessary for the activity are provided by Laura Ferrari. You are advised to bring an apron or wear clothing that can withstand possible paint stains. The works you create during the activity shall remain your property.
3.2. Image Rights
As part of the organisation of workshops or events, Laura Ferrari may occasionally take photographs or videos for promotional purposes. By participating in an event, you authorise Laura Ferrari to use photographs and/or videos taken on that occasion for promotional purposes, unless you inform her otherwise in writing beforehand.
3.3. Cancellation and Refund Policy
You may cancel your registration up to 48 hours before the scheduled event in order to receive a full refund. Cancellations made less than 48 hours before the event are non-refundable, but may, where applicable, be transferred to a person of your choice. If Laura Ferrari has to cancel a workshop or event, a full refund will be offered to you.
3.4. Liability
Laura Ferrari shall not be liable for damages resulting from your participation in an event, except in cases of gross or intentional negligence, within the limits permitted by applicable law. You acknowledge that you are responsible for your own well-being, safety and personal belongings during any event.
4. CONDITIONS APPLICABLE TO THE SALE OF WORKS OF ART OR PRODUCTS
4.1. Prices Prices are indicated in euros. Unless otherwise stated, they exclude delivery costs.
4.2. Delivery and Costs
Delivery costs are borne by you. They are calculated according to the dimensions of the item ordered and the country of delivery. Delivery times are provided for information purposes only. Delivery is made: • to the address you provided; • or by collection from a relay point chosen by you when placing the order; • or orders may also be collected directly and free of charge in Antwerp.
Delivery is deemed to have taken place as soon as the order is handed over to you by the carrier.
4.3. Information on Works of Art and Products
The works of art offered for sale are described and presented as accurately as possible. Although Laura Ferrari endeavours to provide photographs that faithfully represent the original products, colours displayed on screen may differ slightly from reality. Laura Ferrari undertakes to honour orders within the limits of available stock. If an item becomes unavailable after the order has been placed, she undertakes to inform you promptly and to offer you either a similar product or a full refund.
4.5. Warranties:
4.5.1. Customer Acting for Non-Professional Purposes:
The legal warranties provided for in the Civil Code are applicable.
4.5.2. Customer Acting for Professional Purposes:
Any notification of an apparent defect or lack of conformity affecting the delivered products must be sent to Laura Ferrari within 7 days of delivery of the products. Any notification of a hidden defect in the delivered products must be sent to Laura Ferrari within 15 days of the discovery of this defect by the customer or from the moment when the customer could reasonably have discovered it.
Any legal action relating to hidden defects must be brought within 30 days from the discovery of the defects by the customer, or from the moment when the customer could reasonably have discovered them, or from the date on which negotiations with a view to an amicable settlement failed. No product may be returned to the seller without her prior written consent. For a period of one year from delivery of the products, the seller’s warranty is exclusively limited either to the repair or replacement of the defective products, or to the refund or reduction of the invoiced price, without any other compensation. In addition, Laura Ferrari’s liability is excluded in the event of damage caused jointly by a defect in the delivered products and by the fault of the victim or of a person for whom the victim is responsible. The warranty expires after this one-year period.
4.6. Right of Withdrawal
4.6.1. General Provisions
In accordance with the Code of Economic Law, you have the right to notify Laura Ferrari that you withdraw from your purchase, without penalty and without having to state reasons for your decision, within 14 clear days from the day following delivery of the item. Once your intention has been expressed, you have a further period of 14 days to return your purchase.
To exercise your right of withdrawal, you must communicate your decision to withdraw, within 14 days from delivery, by email to lvvferrari@gmail.com or by post to Laura Ferrari, 2018 Antwerpen, Grotehondstraat, 44, using a return form (this withdrawal form appears in Annex 2 of Book VI “Market Practices and Consumer Protection” of the Code of Economic Law – https://economie.fgov.be/sites/default/files/Files/Forms/Formulaire-de-retractation.pdf).
The right of withdrawal applies only on condition that:
• the items are not damaged and are in impeccable condition;
• the items are complete and in their original packaging;
• the items have been stored in a dry place, protected from light, heat and humidity;
• the items are accompanied by their purchase invoice.
Furthermore, in accordance with Article VI.53, 3° of the Code of Economic Law, you may not exercise the right of withdrawal for the supply of goods made to your specifications or clearly personalised.
You will then receive instructions for returning the product without undue delay and, in any event, no later than 14 days following the communication of withdrawal.
The product must be returned at the customer’s expense to Laura Ferrari’s postal address: 2018 Antwerpen, Grotehondstraat, 44.
Laura Ferrari will send a confirmation email after receiving your decision to withdraw and after receiving the parcel, provided that the return is acceptable. Laura Ferrari reserves the right to make only a partial refund if it appears that the returned purchase has been damaged or is incomplete.
4.6.2. Refund
Within 14 days following the communication to Laura Ferrari of your decision to withdraw and after recovery of the products, all amounts paid will be refunded using the same payment method as the one used for your purchase, provided that the return is accepted. Laura Ferrari reserves the right to defer the refund until recovery of the product.
4.7. Non-Conformity
In the event of non-conformity of the order, you are required to inform Laura Ferrari within 24 hours of receiving your order by email at lauraferrari.fineart@gmail.com. The email must contain the order number as well as an explanation detailing the non-conformity and a photo supporting the claim.
4.8. Defective Item
The products are packed and shipped with the greatest care in order to reduce the risk of damage during shipment. If, despite all precautions, the parcel arrives damaged, you must report any damage within 24 hours of receipt, with photos of the products and the packaging, by email to lauraferrari.fineart@gmail.com. You may then return the parcel free of charge and choose a refund or an exchange, subject to acceptance by Laura Ferrari.
4.9. Regarding the Goods Sold
The acquisition of an item, whether an original painting or an art print, grants you ownership of the physical medium, but does not constitute an assignment of copyright or economic rights. Any use, reproduction or distribution of the work outside the private sphere requires the prior authorisation of Laura Ferrari. In accordance with Belgian intellectual property law, Articles XI.165 et seq. of the Code of Economic Law, Laura Ferrari retains all rights relating to the work sold, including, without limitation, reproduction, representation and distribution rights.
5. COMMON GENERAL TERMS
5.1. Intellectual Property
All elements present on the website www.artsowell.com, including texts, drawings, photographs, packaging, videos, data, domain name and other elements, remain the exclusive intellectual property of Laura Ferrari, with the exception of photographs taken by the photographer @lovelikethisphotography, which remain the intellectual property of the latter. Total or partial reproduction or copying, in any form whatsoever and by any means whatsoever, is strictly prohibited without the prior written authorisation of Laura Ferrari. Any breach of this clause may result in legal proceedings.

5.3. General Provisions
The nullity or unenforceability of any clause of these general terms and conditions shall not affect the validity or enforceability of the other clauses. Any communication and notification between the parties shall be validly made by email. The obligations assumed by Laura Ferrari in connection with online sales are considered obligations of means in accordance with Article 5.72 of the Belgian Civil Code.
Her liability may not be incurred:
• for damages resulting from the use of the internet network and online payment;
• in the event of fault in the performance of her services, unless there is fraudulent intent or intentional fault.
5.4. Force Majeure
The occurrence of any event such as, in particular, any interruption of production, transport or delivery, strike, lockout, embargo, war, terrorist attack or consequence of an attack, shortage of raw materials, epidemic, severe weather conditions and, more generally, any similar event affecting the parties or their suppliers and delaying or rendering impossible the performance of their respective obligations, shall suspend the performance of their respective obligations. The party invoking such an event shall notify the other party as soon as possible of proof of its occurrence. The obligations shall be suspended until notification of the end of the event, without compensation. If the force majeure event lasts more than 60 days, the parties shall attempt to renegotiate the performance of the contract.
5.5. Applicable Law and Jurisdiction
These general terms and conditions are governed by Belgian law. Any dispute shall be subject to the exclusive jurisdiction of the courts of Antwerp, Belgium.
